FREE LEMON LAW HELP THROUGHOUT PITTSBURGH, ALTOONA, ERIE, AND WESTERN PENNSYLVANIA

For more than three decades, Kimmel & Silverman has been providing completely cost-free lemon law representation to distressed drivers throughout Pennsylvania and the Northeast.  From our Western Pennsylvania headquarters located in the heart of Pittsburgh, we have been serving clients throughout Allegheny, Armstrong, Westmoreland, Washington, and Beaver counties, as well as Johnstown, Erie, Altoona, and all surrounding areas.

Both laws we work with, the Pennsylvania Lemon Law and the Magnuson Moss Warranty Act have fee-shifting provisions, which means that if our client prevails, the manufacturer must pay all attorney fees and legal costs on top of recourse or as mandatory part of any settlement.  We take it one step further.  When you open a Pennsylvania Lemon Law claim or Federal Warranty claim with the Pittsburgh offices of 1 800 LEMON LAW, there is no out-of-pocket cost, win or lose. We are confident in our abilities and will fight hard to help obtain the recourse you deserve.

Kimmel & Silverman is proud to be the oldest, largest, and most successful Lemon Law firm in Pennsylvania.  Since 1991, we have successfully handled more than 185,000 cases, securing more repurchases and replacements than any other PA Lemon Law firm. We also worked with the State of Pennsylvania government to successfully expand the PA Lemon Law to include leases and tighter title branding for used vehicles in the state and lobbied in front of the House to include motorcycles in the Pennsylvania Lemon Law, an addendum which will finally become a reality in 2025.

So, what could you be entitled to under PA Lemon Law?

If you have purchased or leased and registered your new car in Pennsylvania, or you purchased or leased your vehicle in another state but registered for the first time in Pennsylvania, you could qualify for protection under PA Lemon Law.

The law applies to vehicles that have been back to the dealer for a continuous number of repair attempts for a defect that impairs use, value, or safety (typically three or more), with the first occurrence in the first 12 months or 12,000 miles, whichever comes first. It also applies to vehicles that have been out of service thirty or more days within the first 12 months or 12,000 miles, whichever comes first.  Those days do not have to be consecutive or even address the same issue.

Under the Pittsburgh, PA Lemon Law, depending upon the severity of the issue and number of repair attempts or days out of service, you could be entitled to:

A COMPLETE REPURCHASE INCLUDING TAXES, TAGS, DOWN PAYMENT, FINANCE CHARGES, TRADE IN…EVERYTHING YOU SPENT ON THE CAR, MINUS A SMALL MILEAGE OFFSET TO REFLECT THE MILEAGE WHEN YOU FIRST BROUGHT THE CAR IN FOR SERVICE.   YOU GIVE BACK THE VEHICLE, AND YOU ARE DONE.

AN MSRP TO MSRP SWAP (NOT APPLICABLE WITH LEASES).  If you were to trade in your car, it would suffer significant financial depreciation.  This is a trade without depreciation.  You receive a credit for the MSRP on your car and it may be used toward the MSRP of a brand new car, so ideally it will be a pretty even swap.  You can also apply it toward the MSRP of another model offered by the manufacturer.  And you will have the same equity in the new car as you had in the old car.

You may qualify for FREE legal help if:

  • Your problem occurred under an original or extended manufacturer’s warranty.
  • Your vehicle has been in the shop 3+ times for the same issue or out of service for 30+ calendar days.
  • The defect substantially impairs your vehicle’s use, value, or safety.

If you answered yes to all of the above, you may qualify for compensation under your state’s lemon law or federal warranty law. Call 1-800-LEMON-LAW or click below for help.

IF WE CANNOT SECURE A REPURCHASE OR A NEW CAR, OR IF THE PROBLEM IS FIXED, WE STILL FEEL YOU ARE ENTITLED TO SIGNIFICANT MONETARY COMPENSATION, PLUS YOU GET TO KEEP YOUR CAR.  Your car is NOT branded in any way, shape or form, your warranty remains fully in effect and you do not need to disclose that you received this money at time of trade or sale.

Pittsburgh Lemon Law Frequently Asked Questions

Purchased a used car with a manufacturer’s warranty, or you fall outside Pennsylvania Lemon Law parameters?

Pittsburgh and Western Pennsylvania drivers still have rights to SIGNIFICANT COMPENSATION.

When you purchased your vehicle, you paid for a manufacturer’s warranty that was to ensure that problems were fixed efficiently and effectively and they were not.  So, we aim to secure you compensation to reflect the diminished value of your vehicle as a result of the problem.  You may do whatever you want with this money, And again you maintain full ownership of the vehicle, your vehicle is NOT branded in any way, shape or form, your warranty remains fully in effect and you do not need to disclose that you received this money at time of trade or sale.

AGAIN, BOTH STATE AND FEDERAL LAWS PROVIDE COMPLETELY FREE LEGAL REPRESENTATION TO PITTSBURGH DRIVERS!

Our efforts have been featured in numerous news stories throughout Pittsburgh and Western Pennsylvania including:

  • WPXI TV Pittsburgh
  • WTAE TV Pittsburgh
  • KDKA TV Pittsburgh
  • Pittsburgh Post Gazette
  • Erie Times

And many more!
