Pennsylvania Lemon Law currently covers cars, vans, trucks, and SUVs purchased or leased for personal use. And while the law is a strong one, there is a glaring omission when it comes to drivers’ rights. As of now, there is no set motorcycle lemon law protection in the state.
The most important thing to remember is that just because there is currently no motorcycle lemon law protection in Pennsylvania, this does not mean that you are not protected. Motorcycles in Pennsylvania are currently covered under what is known as the Magnuson-Moss Warranty Act, a federal law governing warranties on consumer products. We have handled thousands of motorcycle claims in the past and much like a state lemon law, the federal law enables the consumer to go after the manufacturer for compensation when the value of the motorcycle is diminished. Also like lemon laws in other states, there is a fee-shifting provision which offers the consumer 100% cost-free legal representation, leveling the playing field between the consumer and the billion-dollar bike company.
And in terms of fighting for a defined Pennsylvania Motorcycle Lemon Law, the battle is far from over. We started lobbying for this over 15 years ago in public hearings. More recently, the Alliance of Bikers Aimed Toward Education of Pennsylvania held a rally in the state capital where they advocated for more consumer protections for motorcycle owners. Many motorcycle owners and lawmakers believe that there is more work to be done and that everyone should be guaranteed consumer protections to the fullest. a motorcycle lemon law statute that would clearly define manufacturer violations and remedies.
In 2017 and again in February of 2019, State Representative Pam Snyder brought a bill to the Pennsylvania House of Representatives amending PA Lemon Law to include motorcycles. While this bill passed on both occasions, it has yet to be voted on by the senate, leaving those consumer protections to the Magnuson-Moss Warranty Act. Is a clear cut law on the horizon? Hard to say, but that should never prevent bikers from fighting for their rights.
