The GMC Acadia water leak issue continues to be a problem. As far back as 2009, we were writing how GMC Acadia drivers were dealing with a water leak problem which was leaving them and their passengers “all wet,” not to mention the floor boards and the electrical systems. Sadly, the problem is now occurring in 2010 and 2011 GMC Acadia vehicles as well.

The good news is we have successfully resolved numerous water leak claims for this vehicle. If you are suffering with a water leak in your GMC Acadia, make sure you return to a General Motors authorized dealer at your earliest opportunity. Try to pinpoint where the leak is coming from so you can provide as much helpful information as possible to your service adviser. Make sure when you pick the vehicle up from service that you also receive a repair invoice which outlines the water leak problem and what was done to address the situation. Check for mold, mildew and headliner stains as well. If the problems continue, you need to keep bringing the Acadia back.

If you are back to the dealer three or more times, you could be entitled to free legal representation under State Lemon Laws or Federal Warranty Laws. You could be looking at a repurchase, a new vehicle or a partial refund and continued ownership of the Acadia. Remember, under the Lemon Law and Federal Magnuson Moss Warranty Act, legal representation is completely free , so you have nothing to lose except your (wet) lemon. If you have questions, feel free to drop us a line or call us at 1 800 LEMON LAW.

Jeep Patriots continue to have massive water leak problems, as do GMC Acadias, Buick Enclaves and Saturn Outlooks.

Ford F-Trucks have diesel problems, resulting in check engine lights, black smoke and stalling among other issues.

BMW models ending in 35 seems to be suffering from fuel pump failure.

Have a Volkswagen EOS? Having a problem getting the top up and down? You are not alone. More and more VW claims are coming in with this issue.

Squeak, squeak, squeak go the brakes on Honda Accords.

We are seeing a lot of alignment issues with Toyota Camry and Lexus models.

In most Chryslers, especially the Town and Country and 300 models, we are seeing transmission shuttering.

Finally, the Dodge Grand Caravan sliding doors are causing massive headaches for many of our clients.

Kimmel & Silverman prides itself on having three full-time ASE certified mechanics who work on our clients’ behalf to review and research automotive defects. If you are having a continuing problem with your car, chances are we have heard about it. Feel free to contact us through our website or by calling 1-800 LEMON LAW (1-800-536-6652).

Amidst tons of debt, the worst sales figures in 25 years, and tens of thousands of layoffs, a new General Motors is emerging and according to CEO Fritz Henderson, the name may be the only similarity between the old company and the new.

The new GM was “born” this morning in a New York press conference, and Detroit Free Press reports that Henderson outlined some major changes right out of the gate. 77-year old Bob Lutz, once retired, is now stepping back into the company fold as Vice Chairman in charge of global design, advertising and communications. Henderson is also laying off 34% of the executive management (approximately 450 executives), and disbanding the Automobile Strategy Board where the company had made most major decisions on new automobiles. Henderson himself will take charge of North American operations.

CBS News is reporting that up to 14,000 hourly workers will also be let go and 2,300 of the manufacturer’s 6,000 dealerships may close.

On the positive side, Henderson says the company will focus on customers, cars and, culture, lauching a “Tell fritz” website to allow the public to share their concerns with senior management, and monthly road trips to “listen to the questions, ideas and concerns of the people who matter most.”: The company is also in the preliminary stages of a possible partnership with ebay to test selling vehicles via on-line auction.

GM is sill in the middle of selling off Hummer, Saab and Saturn. However the new GM will be responsible for any lemon law and breach of warranty claims that arise from these vehicles in the years they were part of the GM family.

The new GM would be 60 percent owned by the US government, 17.5 percent by the United Auto Workers union and 11.7 percent by the governments of Canada and the province of Ontario. Under the reorganization plan, the new company would be created by late August.

In the meantime, we are moving forward with all General Motors lemon law and breach of warranty claims, including Pontiac, Chevrolet, Buick, GMC, Hummer, Saturn, and Cadillac. We currently have a system in place where we can advocate quickly for our clients’ rights, with cases being expedited efficiently. We have been assured that GM is committed to making sure this continues and we applaud the company for continuing to make consumers’ rights a priority. Remedies include full repurchase, or full or partial refunds and as always the legal help is completely cost-free.

In these situations, the driver may experience a sag or hesitation when accelerating during a lane change, or when a lunge when trying to make a complete hard stop.

If you are suffering with this problem, you must bring your vehicle to an authorized GM dealership so they can address the matter. Please reference TSB PIP4112H. Do not allow the dealer to tell you this is a normal characteristic of the vehicle; it is not. Also, make sure that you receive a warranty repair invoice which clearly outlines the problem when you pick up the vehicle.

If you find that the problem can’t be fixed efficiently and effectively after several attempts, please get in touch with us either by phone at 1 800 LEMON LAW (1-800-536-6652) or via e-mail. We will discuss your situation with you and see how we can help.

What does that mean exactly? It means that unlike the previous Chrysler bankruptcy, where lemon law representation was temporarily stayed and settlement checks were bounced, General Motors is still devoted to assisting any clients who suffer repeated problems under warranty, knowing that continued customer loyalty will result in a resurgence of the brand.

Our Firm is still handling lemon law and breach of warranty claims for all General Motors drivers in Pennsylvania, New Jersey, Delaware, Ohio, New York, Connecticut, Massachusetts, and New Hampshire.

It’s a sad day in the history of automobiles. Autoblog reports that General Motors will phase out Pontiac by the end of 2010, and will build its accelerated visibility plan surrounding its four remaining brands: Chevrolet, Buick, GMC and Cadillac. By the end of the year, we will also know if and how GM will move forward with the Saab, Saturn and Hummer brands.

The first Pontiacs were produced in 1926 and their popularity has escalated throughout the decades with the production of the Bonneville, GTO, Firebird, and in later years the G6 and Solstice.

So, what does this mean if you have a Pontiac? Ideally, this situation should not have any effect on your manufacturers warranty or in filing a lemon law or breach of warranty claim if in fact GM cannot fix a non-conformity despite numerous repair attempts. It appears General Motors is standing behind the brand and its warranty and will continue to do so until the make phases out.

And while the value of the vehicles will certainly diminish come trade-in time, if you like the model, now may be a time you can take advantage of the situation and purchase one for a very reasonable price.

Dear Fred: I have received my settlement check and would like to thank you and your firm for time and effort put into my case. I will recommend your firm to friends who have similar problems with their autos, Thanks again. Ted S.

To whom it may concern: I just wanted to thank all involved at the partnership of Kimmel and Silverman for a very competent and professional experience resolving the problems with my 2008 Ford F450. Robert Rapkin, Tiffany DiDomenico and the others involved in my case were very helpful and knowledgeable and facilitated resolution in a very admirable manner. I have already referred your firm to a neighbor with a similar vehicle and will continue to do so in the future. Once again, thanks for a very high quality experience. Phil W.

To Michael Sacks, I have had problems with my 2007 Chevy Tahoe, and I did not know where to turn. A friend of mine told me to contact Kimmel and Silverman. I was assigned Bob Silverman. I am writing to tell you what an absolute joy it was to deal with Bob. He handled my situation in a very professional manner with my interests the only priority. I was very aggravated to say the least that General Motors Corporate would not contact me. He gave me excellent advice and I received a substantial compensation for General Motors negligence. I suppose that is why it is his company. I will gladly refer anyone in a similar situation. Hats off to Kimmel and Silverman. Thank you very much. Sincerly, Lawrence M.

Tracey, I just wanted to express my thanks to you, Patricia Murray and Mr. Silverman this year. My claim was 06 cobalt, I filed this year. Anyways a quick update, I took my $ and literally ran to the nearest Toyota dealer, Then I was ready to trade that bad cobalt and the key was stuck!! It was never ending. Because of your law firm, I now have a 08 beautiful Scion . I might not be alive if it wasn’t for you law firm representing me. I took a big loss obviously since I only had the car 2 years but you guys helped me so much. I can’t believe I am outraged now that GM is broke, after I almost lost my life with that car, and then negative equity with the trade in. Now maybe we are bailing them out too? It’s a hard reality but the great news is how you guys treated me. A painful experience turned into a painless one by your law firm. Patricia

If you have been watching the news today, I am sure you have heard the news that President Bush will be lending Chrysler and General Motors up to $17.4 billion in short term loans from the US government. The package does come with strings attached; they expect the manufacturers to be viable by the end of March and they put significant limits on executive pay and prohibit either company from issuing new dividends.

So, what does this mean exactly? It seems the ball is back in the manufacturers’ court and they have to figure out a way to significantly cut company debt. Expect to see dealerships continue to close, service personnel to dwindle significantly, and the quality of warranty repairs, coupled with time allotted to warranty repairs, to be severely threatened. But what is the alternative? As the President pointed out this morning in his address, if either company declared bankruptcy, their service contracts and warranty obligations would not be a main priority.

Automotive Consumer Advocate and 1-800-LEMON LAW Communications Director Michael Sacks will be discussing the bleak auto industry outlook and answering automotive warranty questions tomorrow morning at 11am on Consumer Hotline on WDEL AM, 1150 on the dial in Wilmington, Delaware. Last time, Michael appeared on the program, a caller phoned in with a Volvo problem and ended up $7,000 richer, so it pays to listen.

Also, everyone’s a member of Facebook these days, even the gang at 1-800 LEMON LAW. If you are a client, former client, or just a fan of our services, we invite you to our new Facebook page and become a fan.

Lawmakers argue that if Chrysler and GM do merge, they will require less federal aid and speed up industry consolidation. There is a chance a merger would be a condition if they receive federal aid.

While many folks are against the rescue plan, there is no question that a bankruptcy would not only continue to wreak havoc on our economy and add millions to those on the unemployment line, but also cause many more dealerships to close. These dealer closures are already leaving many drivers stranded, travelling hundreds of miles for warranty repairs, and waiting for inspection stickers and registration renewals. Next week, we will be providing tips on how to deal with the dealers during this difficult time.

When Bob Silverman & Craig Kimmel formed Kimmel & Silverman eighteen years ago, they had one goal in mind–to equal the playing field between the consumer and the billion-dollar automotive manufacturer, using State & Federal Laws that many consumers were not aware of. Best of all, the legal help under these laws is completely FREE to the consumer.

For the life of us, we cannot understand why consumers still insist on trying to do this by themselves, when you can have access to an experienced attorney who has worked on thousands of lemon law and breach of warranty claims (not only that, but we have three ASE-certified mechanics on staff to inspect our clients’ vehicles and research their issues.) The other day, a gentleman called with a real problem–he was two years into a four-year lease and he was experiencing many problems with his power-train. Being that he thought he had a “slam dunk” case, he decided to represent himself through the NJ Lemon Law unit. He couldn’t get a mechanic to testify on his behalf. The manufacturer hired attorneys to oppose his claim. He ended being offered a very minimal settlement which only covered a few lease payments. He now has decided to buy himself out of his lease, which means he is going to take a huge financial hit. This is all because he thought he could handle this on his own. We have seen many other claims where the consumer was promised a new car, only it turned out to be a trade and the consumer found themselves stuck in a terrible situation. If you are not a doctor, can you diagnose someone with a chest pain? If you are not a contractor, can you build a house and ensure it’s going to last the test of time? The legal help is free, the participation is minimal. You can keep driving your car throughout the entire process….if you don’t take advantage of what the Law provides, then you are partly to blame for whatever happens.

We know that It sounds too good to be true, but we can assure you it is for real. You can read the many consumer stories we have in our on-line newsroom, or just take a look at some of our recent victories from the last quarter. The following are some of the repurchases we have successfully obtained in the last four months. These clients received all taxes, tags, finance charges, monthly payments and value on their trade-ins, minus a very small mileage offset normally based on the mileage when they first brought the car to the authorized manufacturers dealership for service. And how much did they pay for legal fees? if you answered “nothing,” you get a gold star!

Now, remember this is a legal process, so we can’t guarantee that you will receive a repurchase if you open a claim with us, but it could be possible.

Under the Laws we work with, a repurchase is the maximum remedy a consumer can receive. Repurchases are reserved where the consumer has suffered a significant non-conformity which has affected the use, value and safety of the vehicle, and the problem has reoccurred repeatedly. Another possible remedy under the Lemon Law is a new car. This known as an MSRP to MSRP swap, which is essentially a trade without the depreciation you would normally suffer. As you know, the minute you drive a car off the lot, the value of the car depreciates significantly. If you receive a swap, we take the MSRP from the sticker price of your car and apply it to the MSRP of a brand new car. So, essentially you are getting a brand new car with the same features, and you have the same amount of equity in the new car as you did in the old car. The depreciation you would normally deal with does not apply.

There is also a third remedy under the State Lemon Laws and most commonly under the Federal Magnuson Moss Warranty Act–significant monetary compensation to reflect the diminished value of the vehicle for the problems you have incurred. This could apply if it is fixed after three repairs; if the problem is not threatening the overall use, value, or safety f the vehicle (i.e. radio); it falls outside the lemon law mileage provisions; or if you purchased the car used but it still has a manufacturers warranty. If you receive money, it is non-taxable and YOU GET TO KEEP YOUR CAR and your car is not branded in any way, shape or form. Plus, your warranty remains completely in effect, so the manufacturer is still obligated to fix the car if problems persist, and you do not need to disclose that you received this money at time of trade or sale. You may do whatever you want with the money. You may have previously read in our blog about the Volvo SUV owner who received $7,000 after he heard Communications Director Michael Sacks on the radio. Here are some other folks who received monetary awards in the last four months(All of these folks kept their vehicles and had their attorney fees paid sepearately by the manufacturer):

2008 Volvo C70 — problems with convertible top, fixed after 4th attempt. Client received $10,000.

2008 Ford Ranger — client received $5,000.

We know that what goes down must come up eventually, so hopefully, we can ride out this emotional roller coaster. One thing we know for sure is that, with the exception of those who keep millions stashed under their bed and in their safe deposit box, we are all in this together. And that includes automobile manufacturers. Repeatedly, we have told you about the economic turmoil among the manufacturers. General Motors shares continue in a spiral downward trend, and if you think Ford, Chrysler or any of the automakers is doing that much better, you are sadly mistaken. Will any of them declare bankruptcy? We hope not. Are they in tremendous danger? Absolutely.

So what does this mean for you, Mr. & Mrs. Car Owner? We know that loans and financing are certainly going to be harder to come by, and chances are manufacturers will also not be so lenient with warranty repairs. If they can’t find the problem, then they can’t find the problem, and it’s highly unlikely they are going to invest the time and money to try and find it. As we have repeatedly advised consumers, if you are experiencing a problem, you will need to be as descriptive as possible. Are you hearing a noise? Where is the noise coming from? When doe the noise occur? What exactly does it sound like? Offer to go with the service manager on a test ride. Help them help you.

And if the manufacturer can’t fix or find your problem, then what? Well, you can call the customer service hotline, and speak to a representative. They will be glad to hear you out and they may present you with a claim number. A follow-up call may offer one to two months payment, or an extended warranty if you are absolutely lucky. Chances are good you will never hear them again. The industry is suffering; they are not looking at offering you a handout without a fight. And you can scream at your dealer until you are blue in the face. As we have repeatedly told you, the dealer is not the defendant. The fact is if you want to take action, you NEED to file a lemon law claim. The beauty of filing a claim under the State Lemon Law or Federal Warranty Law is that legal help is free. Under the fee-shifting provisions of these laws, your attorneys’ fees and legal costs are covered by the manufacturer ON TOP OF what of you receive. It’s very important that you make sure that the lemon law firm you use provides completely free legal help. With 1-800-LEMON-LAW, it is 100% cost-free win or lose, but it not like that with every firm. Make sure you make sure that the law firm you are using provides completely cost-free legal representation. Ask questions.

The fact of the matter is that if you do nothing, you will get nothing. During this especially difficult time, no manufacturer is going to go out of their way to help you. if you have been in three or more times for the same problem under warranty, or your vehicle has been in the shop for a significant number of days, call us at 1-800 LEMON LAW. We will be glad to go over your situation with you. You could be looking at brand new car or a full refund, and if your car is fixed after three or four attempts, you could STILL be looking at significant monetary compensation (plus, you keep your car and your warranty remains completely in effect.) The laws are out there to protect you, and protect your investment. Take advantage of your consumer rights. Utilize lawyers who understand the law, who work on these types of cases, who have access to the manufacturers’ legal team. Our firm has three ASE-certified mechanics who work full-time inspecting our clients’ vehicles and researching their defects. And it does not cost our client one penny. Fight for your rights, because if you don’t, no one will do it for you. If you have any questions, feel free to drop us a line or fill out our Get Rid Of Your Lemon page, and we will contact you promptly.

As the rain has been pouring down this past week, the calls have been pouring into 1-800 LEMON LAW . We have been successfully resolving a large number of water leak claims recently, especially in General Motors SUVs. But, GM drivers are not alone; I just took a call from a gentleman who has been in 7 times for a water leak in his trunk…and he drives a 2007 Honda Accord! There is no doubt that as the weather continues to get wetter, many distressed drivers will locate a leak. So what do you do if you find a drip?

We have repeatedly provided tips on what to do if your car leaves you all wet. Provided you are under manufacturers warranty, make sure you take your car to an authorized manufacturers dealer as promptly as possible. And, when you pick up the car, make sure you also pick up a repair invoice that outlines the problem and what they have done to resolve it. Keep these invoices in a safe place. If you are facing this problem repeatedly, and the service manager is leaving you out to dry, you need to take action. If you are in the shop three times under warranty for a leak, you have the right to file a lemon law or breach of warranty claim EVEN IF THEY EVENTUALLY FIX THE PROBLEM. Why? Because your vehicle has suffered a non-conformity which significantly affected its use, value and safety. A decent claim could result in significant monetary compensation…we are talking a partial or full refund…possibly even a new car. And as you know, under your lemon laws and federal laws we work with, the legal help is completely FREE.

And let’s say they fix the leak? How sure are you that the leak will not return? Or worse yet, you may discover mold and/or mildew. Unfortunately, one thing we see time and time again are folks who do not open a claim because their problem is fixed…and then it pops up again 15,000 or 20,000 miles “down the road.” The case is weaker. The remedy is usually weaker.

If you are find yourself ready to flip after discovering your drip, contact us via e-mail or phone at 1-800 LEMON LAW (1-800-536-6652) and we will be glad to discuss the situation with you and how we can help.

Speedway Motorsports Inc., which owns eight tracks that hold NASCAR events, already has been told GM will not renew contracts at two tracks — New Hampshire Motor Speedway and Bristol Motor Speedway. In addition, the company has suspended its stock dividend, another huge blow to investors who have seen their shares dip to the lowest prices in fifty years. And finally, to reward those employees who have stood by the company through its trials and tribulations, The Street is reporting that they will no longer offer health care to retirees, effective January 1, 2009.

However, depsite the gloom and doom that has been haunting the automaker, the company is remaining optimistic with their plans for the upcoming year. A story in the Baltimore Sun reports that GM’s sales fell 16 percent in the first half of the year, with trucks off 21 percent and cars down nearly 9 percent. GM Prez Fritz Henderson says that for the company to succeed, they must repair their car brand image and “steer” away from trucks (pun intended.) The Chevrolet Malibu has seen its sales increase a whopping 46 percent in the first half of the year, even though the new and improved quality and style resulted in an MSRP increase of $4000. Eighteen of the 19 vehicles GM will unveil between now and 2010 will be cars or crossovers, including a smaller Cadillac.

The manufacturer is also kicking the clunky Cobalt to the curb, replacing it with the sleek Cruze, a little powerhouse with a 1.4 liter turbo-charged four-cylinder engine that will allow it to get a fantastic 45 miles per gallon. The Cruze is coming to a GM dealer near you in 2010.

Bloomberg reports that the company has suffered a 16 percent decline in 2008 U.S. auto sales and the price of GM stocks is now at a 54-year low (Shares have tumbled 62% this year, the most among the 30 companies in the Dow Jones Indsutrial Average). However, despite continuous speculation that GM could file for bankruptcy in the next year, Chief Executive Officer Rick Wagoner says that the company has “no thoughts whatsoever” of bankruptcy. Wagoner also says that Hummer is the only one of GM’s U.S. brands being studied for possible sale or shutdown. As gas prices continue to soar, the manufacturer will review the truck’s future and sales potential. He adds that the bankruptcy rumors have not resulted in any drop in sales, with GM sales falling less than 1 percent in the first three months of the year.

As a company, GM has not posted an annual increase since 2004, with no U.S. sales gain since 1999. Last year, they suffered an astounding $38.7 billion loss. Outside analysts say that in a worst case secnario, with sales continuing to decline and an inability to acquire much needed captial, GM might have to declare bankruptcy by the end of 2009 or beginning of 2010, but they put the odds of that happening at 25 percent.

The battery kept dying, again and again, and he found himself back at the dealer on five different occasions. He thought that General Motors would certainly do the right thing and exchange his car with a new one under the Pennsylvania Lemon Law. When they refused, he upped the ante and told the dealer he would pay them $10,000 and turn in his car in exchange for a new car and he was still getting the run-around. It was around that time that his daughter got involved. She had heard about Kimmel & Silverman and she looked up lemon law.com on-line. Once John contacted us, we started representation and shortly after, John received an MSRP to MSRP swap, exchanging his 2003 Cadillac for a 2008 Cadillac. He paid NO attorney fees (as you know, if we can help, it is completely free) and only paid $2,400 in mileage and upgrade offset, MUCH LESS than what he offered the dealer. Needless to say, he was thrilled.

So, what’s the moral of the story? Dealers can only do so much to help the consumer. When dealing with a lemon law or breach of warranty issue, the defendant is NOT the dealer; it is the manufacturer. Many a dealer has whispered “1-800-LEMON-LAW’ to their customers over the years. They do this because they know they have no control, and really want to help. If you find yourself in a similar situation, don’t bend the dealer’s ear, hoping that he will come to your rescue. Instead, research your lemon law and breach of warranty rights, make sure you keep all of your repair invoices, and look into hiring a lemon law attorney. It is cost-free and risk-free.

For those in the Delaware Valley, “Speak Up” will air this Sunday morning at 8am on CW57. In addition to John, the program will feature lemon law attorney Amy Bennecoff and Director of Communications & Automotive Consumer Advocate Michael Sacks.
