<p>Let&#8217;s start with Nissan, <a title="Nissan recall" href="http://www.nydailynews.com/money/2010/03/03/2010-03-03_nissan_recalls_over_half_a_million_vehicles.html" target="_blank">who has announced a recall of 539,864 vehicles due to faulty brake pedal pins and fuel gauge components</a>.   Those models affected by the brake pin recall include 2008-2010 Nissan Titan, Armada, Quest and the high-end Infiniti QX56.There have been three reported instances of brake pedal pins partially disengaging, causing a loss of normal braking activity and Nissan has centered the problem on the supplier&#8217;s part.  All Nissan vehicles currently on sale are free of this problem.</p>
<p>The fuel gauge recall affects 2005-2008 Nissan Titan, Armada, Quest and Infiniti QX56 models, as well as an Nissan Frontier, Pathfinder and Xterra models produced between January and March 2006 or between October 2007 and January 2008.  Vehicles at higher mileage may have fuel gauges which incorrectly indicate the amount of fuel in the tank.  This may result in the vehicle running out of gas even through the gauge does not read empty.</p>

<p>On the General Motors front, <a title="GM recall" href="http://www.csmonitor.com/Money/new-economy/2010/0302/GM-recall-What-to-do-if-your-Chevy-or-Pontiac-is-on-the-list" target="_blank">the manufacturer is recalling 1.3 million vehicles due to faulty steering systems</a>.  This comes as no surprise to us as we have received countless calls, and have resolved well over a thousand cases, pertaining to faulty steering systems in Chevrolet, Pontiac and GM models.</p>
<p>The recalled models include 2005-2010 Chevrolet Cobalts and 2007-2010 Pontiac G5 models.   The sudden loss of power steering can occur at any time and consumers are urged to not wait for the recal notice if the problem happens.  They are to report to an authorized manufacturer&#8217;s dealer immediately for assistance.</p>
<p>When the power steering problem occurs, drivers will hear a chime sound while a power steering indicator lights up on the dashboard.  The vehicle will be difficult to steer, especially under 15 miles per hour.  The problem has so far resulted in 14 reported accidents, although we have seen many occurrences of this.  For more information on the GM recall, call 800-222-1020.</p>

<p>NHTSA says more than 1,132 complaints have been filed by Cobalt drivers, with eleven accidents and one injury reported.  Most of these incidents have occurred within the past six months.  Drivers complained that once the power steering system failed, it became difficult to control their car and keep it in the traffic lane. </p>
<p>General Motors has said they will answer any questions posed during the investigation, and the case will either result in an analysis of the power steering engineering or the matter will be closed.</p>
<p><a title="lemon law pa nj ny oh nh ma ct de tn mi" href="http://www.lemonlaw.com" target="_blank">Kimmel &amp; Silverman </a>frequently receives calls from distressed drivers who have complained about power steering in their Cobalts, as well as other GM vehicles including the Imapla and Malibu.  That being said, we have found that General Motors is a very responsible company and takes consumers&#8217; issues very seriously.  Most power steering issues we have brought to the company&#8217;s attention have been resolved efficiently to the consumer&#8217;s satisfaction.  Most claims we open start with power steering noises, where steering shafts have been lubed or steering columns have been replaced.</p>

			<content:encoded><![CDATA[<div class="addthis_toolbox addthis_default_style" addthis:url='http://www.lemonlaw.com/wordpress/gm-to-accept-lemon-law-liability/' addthis:title='GM to Accept Lemon Law Liability' ><a class="addthis_button_facebook_like"></a><a class="addthis_button_tweet"></a><a class="addthis_button_google_plusone"></a></div><p>As <a title="gm lemon law blog entry" href="http://www.lemonlaw.com/wordpress/are-gm-drivers-still-protected-under-the-lemon-law/" target="_blank">previously reported </a>in the Lemon Law Blog on June 4th, General Motors intends to accept responsibility for all <a title="lemon law" href="http://www.lemonlaw.com" target="_blank">lemon law </a>and breach of warranty claims of past, present and future leases and sales.  A <a title="reuters gm lemon law report" href="http://www.reuters.com/article/businessNews/idUSTRE55R2BZ20090628" target="_blank">Reuters</a> report confirmed General Motor&#8217;s responsibility, as the manufacturer moves forward with a bid to win court approval to reorganize the company.</p>
<p>The new GM would be 60 percent owned by the US government, 17.5 percent by the United Auto Workers union and 11.7 percent by the governments of Canada and the province of Ontario.   Under the reorganization plan, the new company would be created by late August.</p>
<p>In the meantime, we are moving forward with all General Motors lemon law and breach of warranty claims, including Pontiac, Chevrolet, Buick, GMC, Hummer, Saturn, and Cadillac. We currently have a system in place where we can advocate quickly for our clients’ rights, with cases being expedited efficiently.  We have been assured that GM is committed to making sure this continues and we applaud the company for continuing to make consumers’ rights a priority. <p>In these situations, the driver may experience a sag or hesitation when accelerating during a lane change, or when a lunge when trying to make a complete hard stop.</p>
<p>If you are suffering with this problem, you must bring your vehicle to an authorized GM dealership so they can address the matter.  Please reference TSB PIP4112H.  Do not allow the dealer to tell you this is a normal characteristic of the vehicle; it is not. Also, make sure that you receive a warranty repair invoice which clearly outlines the problem when you pick up the vehicle.</p>

			<content:encoded><![CDATA[<div class="addthis_toolbox addthis_default_style" addthis:url='http://www.lemonlaw.com/wordpress/are-gm-drivers-still-protected-under-the-lemon-law/' addthis:title='Are GM Drivers Still Protected Under The Lemon Law?' ><a class="addthis_button_facebook_like"></a><a class="addthis_button_tweet"></a><a class="addthis_button_google_plusone"></a></div><p>Good news for GM Owners&#8211;In the company&#8217;s proposed Master Transaction Agreement, it specifically says that GM &#8220;will continue to accept all liabilities under express written and limited new vehicle warranties, certified used vehicle warranties, and pre-owned vehicles warranties delivered in connection with the sale of new, certified used, or pre-owned vehicles manufactured or sold by Sellers or Purchaser prior to or after the closing.&#8221;</p>
<p>What does that mean exactly?  It means that unlike the previous Chrysler bankruptcy, where lemon law representation was temporarily stayed and settlement checks were bounced, General Motors is still devoted to assisting any clients who suffer repeated problems under warranty, knowing that continued customer loyalty will result in a resurgence of the brand.</p>

<p>We find this list to be rather incomplete, as it only covers vehicles that were purchased back from the manufacturer and officially titled as lemons. The list does not include vehicles where consumers received thousands of dollar in monetary damages and were able to keep their cars.</p>
<p>Being that we are the oldest and largest <a title="pa lemon law" href="http://www.lemonlaw.com" target="_blank">lemon law </a>firm in Western Pennsylvania, Paul asked us to compile a list of the cars we see the most in our Pittsburgh caseload. The manufacturer hired attorneys to oppose his claim.  He ended being offered a very minimal settlement which only covered a few lease payments.  He now has decided to buy himself out of his lease, which means he is going to take a huge financial hit.  This is all because he thought he could handle this on his own.  We have seen many other claims where the consumer was promised a new car, only it turned out to be a trade and the consumer found themselves stuck in a terrible situation.  If you are not a doctor, can you diagnose someone with a chest pain? If you are not a contractor, can you build a house and ensure it&#8217;s going to last the test of time?  The legal help is free, the participation is minimal.  You can keep driving your car throughout the entire process&#8230;.if you don&#8217;t take advantage of what the Law provides, then you are partly to blame for whatever happens.</p>

<p>Now, remember this is a legal process, so we can&#8217;t guarantee that you will receive a repurchase if you open a claim with us, but it could be possible.</p>
<p>Under the Laws we work with, a repurchase is the maximum remedy a consumer can receive.  Repurchases are reserved where the consumer has suffered a significant non-conformity which has affected the use, value and safety of the vehicle, and the problem has reoccurred repeatedly.  Another possible remedy under the <a title="lemon law information" href="http://www.lemonlaw.com/auto-lemon-law.html" target="_blank">Lemon Law </a>is a new car. This known as an MSRP to MSRP swap, which is essentially a trade without the depreciation you would normally suffer.  As you know, the minute you drive a car off the lot, the value of the car depreciates significantly.  If you receive a swap, we take the MSRP from the sticker price of your car and apply it to the MSRP of a brand new car.  So, essentially you are getting a brand new car with the same features, and you have the same amount of equity in the new car as you did in the old car. The depreciation you would normally deal with does not apply.</p>
<p>There is also a third remedy under the <a title="state lemon law" href="http://www.lemonlaw.com/automobile-lemon-law.html" target="_blank">State Lemon Laws </a>and most commonly under the <a title="magnuson moss warranty act lemon law blog entries" href="http://www.lemonlaw.com/wordpress/category/magnuson-moss/" target="_blank">Federal Magnuson Moss Warranty Act</a>&#8211;significant monetary compensation to reflect the diminished value of the vehicle for the problems you have incurred. This could apply if it is fixed after three repairs; if the problem is not threatening the overall use, value, or safety f the vehicle (i.e. radio);  it falls outside the lemon law mileage provisions; or if you purchased the car used but it still has a manufacturers warranty.  If you receive money, it is non-taxable and YOU GET TO KEEP YOUR CAR and your car is not branded in any way, shape or form.  Plus, <span style="text-decoration: underline;">your warranty remains completely in effect, so the manufacturer  is  still obligated to fix the car if problems persist,</span> and you do not need to disclose that you received this money at time of trade or sale.  You may do whatever you want with the money.  You may have previously read in our blog about the Volvo SUV owner who received $7,000 after he heard Communications Director Michael Sacks on the radio. Here are some other folks who received monetary awards <span style="text-decoration: underline;">in the last four months</span>(All of these folks kept their vehicles and had their attorney fees paid sepearately by the manufacturer):</p>

For that reason, since 2001, we have teamed up consumer advocate Jack Gillis and the wonderful team at the<a title="Center for Auto Safety" href="http://www.autosafety.org" target="_blank"> Center for Auto Safety </a>to provide the <a title="lemon law.com car complaint index " href="http://www.lemonlaw.com/carcomplaintindex.html" target="_blank">Car Complaint Index </a>to consumers.  We feel that an educated consumer is an effective consumer. </p>
<p>Yesterday, JD Power &amp; Associates came out with their <a title="jd power rankings" href="http://abclocal.go.com/wpvi/story?section=news/consumer&amp;id=6312104" target="_blank">dependability rankings </a>and it appears that Land Rover is lowest on the Power totem pole.  While the Car Complaint Index looks at specific models, JD Power looks at brand quality.  They rank their cars based on an average of car problems; how many problems are reported per 100 cars, as experienced by original owners of these cars after three years.  The industry average is 206 problems per 100 cars, roughly averaging 2 problems per car.</p>
<p>Here are the brands that fall below the industry average:  Audi 207, Mercedes Benz 215, Nissan 224, Pontiac 225, GMC 226, Mazda 228, Subaru 228, Chrysler 229, Dodge 230, Mini 233, Chevrolet 239, Hummer 241, Scion 243, Volvo 244, Saturn 250, Jeep 253, Volkswagen 253, Saab 254, Isuzu 274, Kia 278, Suzuki 302, and lastly Land Rover with 344 problems reported per 100 cars.  This is not good news for the SUV manufacturer, which was recently sold by Ford to an Indian company.</p>
<p>So, who&#8217;s on top?  Number one with a bullet for the 14th consecutive year is Lexus, followed by Mercury and Cadillac.</p>

As a result, our <a title="ask a lemon law question" href="http://www.lemonlaw.com/mail.html">lemon law mailbox </a> has been &#8220;flooded&#8221; with questions like this:</p>
<p>&#8220;I bought a Chevrolet Aveo about a month and a half ago. Yesterday we had a rain storm and I went out to my car, the entire windshield on the inside was dripping wet&#8230;what are my options?&#8221;</p>
<p>The day after a storm, many distressed drivers discover leaks in their vehicles. And, if those leaks are not immediately addressed and repaired, your car will soon be a nesting ground for <a title="Is your lemon car making you sick?" href="http://www.lemonlaw.com/carsick.html">mold and mildew</a>.  So, what should you do if you find puddles on your passenger floor (or elsewhere in the car)?</p>
<p>**Make a service appointment with your dealership immediately. Make sure the <a title="dealing with service managers" href="http://www.lemonlaw.com/kit.html">service manager</a> understands the severity of the situation.</p>
<p>**Try to track down where the leak or <a title="mold and mildew lemon law problem" href="http://www.lemonlaw.com/breakmold.html">mildew</a> scent is coming from. If you can point your service manager in the right direction, they may be able to fix it immediately. Also, let the service manager know when the scent is the strongest (i.e. when starting up the car, when turning on the heater to high, when turning on the rear defroster, when it rains.) The more information you can provide your service manager, the better!</p>
<p>**Make sure you receive a repair invoice outlining your problem and their solution. Do not let them mail the invoice. Have them print out the invoice when you pick up your car.</p>
<p>**If you still smell the fumes after your service, you need to bring the car back to an authorized dealership for another repair attempt. If you feel your dealership is not handling the problem correctly, take your car to another authorized manufacturers dealership.</p>
<p>**If your car is under manufacturer&#8217;s warranty, you should not have to pay any extra monies for treatments or ventilation services. This problem should be covered under both the original and extended manufacturer&#8217;s warranties.</p>
<p>**If your car is under manufacturer&#8217;s warranty and you have given the manufacturer 3 or more chances to fix the problem, you can assert your rights to cost-free legal representation under <a title="lemon law summaries" href="http://www.lemonlaw.com/automobile-lemon-law.html">State Lemon Laws </a>or Federal Warranty Laws.</p>
<p>Don&#8217;t let your manufacturer leave you hanging out to dry. Take <a title="get rid of your car" href="http://www.lemonlaw.com/rid.html">action</a> if necessary.</p>

And finally, to reward those employees who have stood by the company through its trials and tribulations, <a title="Street report on GM" href="http://www.thestreet.com/s/gm-cuts-retiree-health-care-what-next/funds/life-lessons-one-zero-one-dummy/10426660.html?puc=googlefi&amp;cm_ven=GOOGLEFI&amp;cm_cat=FREE&amp;cm_ite=NA" target="_blank">The Street </a>is reporting that they will no longer offer health care to retirees, effective January 1, 2009.</p>
<p>However, depsite the gloom and doom that has been haunting the automaker, the company is remaining optimistic with their plans for the upcoming year. A story in the <a title="baltimore sun story on 2009 general motors cars" href="http://www.baltimoresun.com/business/bal-bz.gmsurvival17jul17,0,3775998.story" target="_blank">Baltimore Sun </a>reports that GM&#8217;s sales fell 16 percent in the first half of the year, with trucks off 21 percent and cars down nearly 9 percent. GM Prez Fritz Henderson says that for the company to succeed, they must repair their car brand image and &#8220;steer&#8221; away from trucks (pun intended.) The Chevrolet Malibu has seen its sales increase a whopping 46 percent in the first half of the year, even though the new and improved quality and style resulted in an MSRP increase of $4000. Eighteen of the 19 vehicles GM will unveil between now and 2010 will be cars or crossovers, including a smaller Cadillac.</p>
<p>The manufacturer is also kicking the clunky Cobalt to the curb, replacing it with the sleek Cruze, a little powerhouse with a 1.4 liter turbo-charged four-cylinder engine that will allow it to get a fantastic 45 miles per gallon.  The Cruze is coming to a GM dealer near you in 2010.</p>
