			<content:encoded><![CDATA[<p>There is no doubt that we are all looking for ways to save money and  that should extend to car buying.  You can save considerably when purchasing a used car versus a new car.  That being said, you need to prepare yourself to make sure that the dream car you purchased was not someone else&#8217;s nightmare.</p>
<p>First, when buying a used car, you MUST ask questions.  Do not be shy.  Did you know that a dealer does not have to disclose that a car has been in an accident unless they are asked?  They don&#8217;t have to disclose the car is a previous rental, repo or fleet car either.  You need to inquire about anything and everything.  You also need to run a vehicle history report to ensure the car does not have a salvage or lemon history.   We like <a title="Experian Autocheck" href="http://www.autocheck.com" onclick="javascript:pageTracker._trackPageview('/outbound/article/www.autocheck.com');" target="_blank">Experian&#8217;s Autocheck</a>, which offers unlimited monthly reports for $44.99.  And you should consider hiring an outside mechanic to inspect the vehicle prior to signing on the dotted line.  This is a simple $100 investment which could save you thousands down the road.</p>
<p>Make sure you inquire about the warranty.  Ideally,  you want to make sure you have a manufacturers warranty.  Dealer and third party warranties often cover very little and have a great deal of fine print.  Understand the terms of your warranty and its coverage. Furthermore, if you have a car under a manufacturers warranty, and you are back three or more times for the same problem, you could be entitled to monetary compensation under the Federal <a title="Magnuson Moss Warranty Act" href="http://www.lemonlaw.com/wordpress/category/magnuson-moss/"  target="_blank">Magnuson Moss Warranty Act</a> we are always talking about.</p>
<p>Lastly, we recommend that you print out a copy of our <a title="lemon dodger worksheet" href="http://www.lemonlaw.com/lemondodger.html"  target="_blank">Lemon Dodger</a> worksheet, which lays out all the information you need to know before taking the car off the lot.  We know it may seem excessive, but it will help you tremendously.</p>
<p>Remember, an educated consumer is an effective consumer and you certainly don&#8217;t want to be steered toward a lemon.</p>

			<content:encoded><![CDATA[<p>The Car Allowance Rebate System (aka Cash for Clunkers) has ceased, but that does not mean you cannot get cash if your car is a clunker. </p>
<p>We repeatedly discuss the <a title="Magnuson Moss Warranty Act" href="http://www.lemonlaw.com/wordpress/the-magnuson-moss-warranty-act-a-hidden-gem-most-consumers-do-not-know-about/"  target="_blank">Magnuson Moss Warranty Act</a>, which provides distressed drivers with monetary damages if their car, truck or motorcycle has been back in the shop repeatedly for the same repairs, but does not fall under Lemon Law parameters.   <a title="lemon law lawyer craig kimmel" href="http://www.lemonlaw.com/lemon-law-attorney.html#craigthorkimmel"  target="_blank">Lemon Law Lawyer Craig Thor Kimmel </a>recently joined Ukee Washington on <a title="cw philly" href="http://cbs3.com/cwphilly/morninglinks" onclick="javascript:pageTracker._trackPageview('/outbound/article/cbs3.com');" target="_blank">Eyewitness News This Morning on the CW Philly </a>to discuss the Magnuson Moss Law and how it works.</p>
<p>Under the Federal law, which provides protection for any consumer who purchases a product over $25, a consumer can receive monetary damages from the manufacturer to reflect the diminished value of the product as a result of the repeated problems.  At <a title="lemon law firm " href="http://www.lemonlaw.com/about.html"  target="_blank">Kimmel &amp; Silverman</a>, we have used this Law to help folks with faulty vehicles, motorcycles, ATVS, computers and appliances. </p>
<p>The best part for drivers who use this law is that they are entitled to monetary compensation even if the vehicle is finally fixed after repeated attempts. 			<content:encoded><![CDATA[<p>As you can imagine, distressed drivers submit hundreds of questions each week to <a title="lemon law" href="http://www.lemonlaw.com/" >Lemon Law.com</a>, hoping to find out more information about <a title="why use the lemon law" href="http://www.lemonlaw.com/auto-lemon-law.html" >lemon law</a>, breach of warranty and dealer fraud claims. And without fail, at least ten times a day, we receive this one-line inquiry:  &#8220;Are used cars covered under the Lemon Law?&#8221;</p>
<p>If we had a nickel for every time we received this question, we would be billionaires many times over.  In the nutshell, the answer is no.  The <a title="state lemon laws" href="http://www.lemonlaw.com/automobile-lemon-law.html" >Lemon Laws</a> we work with apply to new or demo cars purchased or leased by authorized manufacturers dealerships.  Now, does that mean that if you purchase a used car, you are up the creek?  Not necessarily.  If you purchased a used car with an original or extended manufacturers warranty, and you find yourself having to go back to the dealer three or more times for the same repair, you very well may have rights under the Federal Law we are always talking about, known as the Magnuson Moss Warranty Act.  Under this Law, you would be entitled to significant monetary compensation from the manufacturer to reflect the diminished value of your car as a result of the problems you have incurred.  In other words, part of what you pay for is a manufacturers warranty and that is the ensure that problems are fixed efficiently and effectively.  If they are not being fixed, there is a breach of warranty and you are entitled to money back.</p>
<p>In many of these cases, you could be looking at 15-35% of what you paid back in your pocket.  This money is non-taxable, you get to keep your car, and your warranty remains completely in effect.  In fact, if the car is fixed after 3-4 attempts, you still are entitled to remedy under this law. You do not need to disclose that you received this money at the time of trade or sale and your car is NOT branded a lemon on <a title="carfax" href="http://www.carfax.com" onclick="javascript:pageTracker._trackPageview('/outbound/article/www.carfax.com');" target="_blank">carfax</a>.  This is essentially free money in your pocket to pay you back for the defect you have dealt with.</p>
<p>And the best part of all is like the Lemon Law, the Magnuson Moss Warranty Act has a fee-shifting provision which means that if you prevail the manufacturer must pay all attorney fees and legal costs on top of what you receive.  Thus, there is no cost and no risk to filing a claim.</p>

<p>Now, without further ado, here is a quick rundown of the laws in the States we practice.  Click on the State for more information.  For information on other state, please visit <a title="lemon law america" href="http://www.lemonlawamerica.com" onclick="javascript:pageTracker._trackPageview('/outbound/article/www.lemonlawamerica.com');" target="_blank">Lemon Law America</a>.</p>
<p><a title="pennsylvania lemon law" href="http://www.lemonlaw.com/pa-lemon-law.html"  target="_blank">Pennsylvania Lemon Law </a>:  First problem must occur in first 12 months or 12,000 miles whichever comes first.  The problem must occur three or more times under warranty OR the car is in the shop 30 or more days within the first year, and those days do not have to be consecutive. Car must be purchased (or leased) and registered in PA.  Motorcycles are not covered under PA Lemon Law  (but they are covered under the Federal Magnuson Moss Warranty Act so we can still help!)–<a title="pa lemon law includes leases" href="http://www.lemonlaw.com/lemonlease.html"  target="_blank">Kimmel &amp; Silverman was directly responsible for getting leased cars included under the PA Lemon Law.</a></p>
<p><a title="new jersey lemon law" href="http://www.lemonlaw.com/nj-lemon-law.html"  target="_blank">New Jersey Lemon Law</a> :  <a title="nj lemon law ranking" href="http://www.lemonlaw.com/nj-lemon-law-ranking.html"  target="_blank">Second most effective Lemon Law in the Nation!</a> First problem must occur in first 24 months or 18,000 miles which ever comes first. Problem must occur three or more times under warranty OR the car is in the shop for 20 days in the first 24 months/18,000 miles and they do not have to be consecutive. Motorcycles are covered under NJ Lemon Law. Vehicle can be purchased, leased or registered in New Jersey.</p>
<p><a title="delaware lemon law" href="http://www.lemonlaw.com/delaware-lemon-law.html"  target="_blank">Delaware Lemon Law </a>: First problem must occur in the first year of ownership.  Problem must occur four or more times under warranty OR the car is in the shop 30 or more BUSINESS days in the first year. Vehicle can be purchased, leased or registered in Delaware. Motorcycles are not covered under DE Lemon Law  (but they are covered under the Federal Magnuson Moss Warranty Act so we can still help!)</p>
<p><a title="maryland lemon law" href="http://www.lemonlaw.com/maryland-lemon-law.html"  target="_blank">Maryland Lemon Law </a>: First problem must occur in the first 15 months or 15,000 miles of ownership. Problem must occur four or more times under warranty OR the car is in the shop 30 or more days in the first 15 months. Vehicle must be purchased or leased in Maryland. Motorcycles are covered.  Commercial trucks under one ton are also covered.</p>
<p><a title="Massachusetts Lemon Law" href="http://www.lemonlaw.com/massachusetts-lemon-law.htm"  target="_blank">Massachusetts Lemon Law </a>: First problem must occur in the first year or 15,000 miles whichever comes first. Problem must occur three or more times under warranty OR the car is in the shop 15 BUSINESS days in the first year. Motorcycles are not covered under MA Lemon Law  (but they are covered under the Federal Magnuson Moss Warranty Act so we can still help!)</p>
<p><a title="Ohio Lemon Law" href="http://www.lemonlaw.com/ohio-lemon-law.html"  target="_blank">Ohio Lemon Law </a>: First problem must occur in the first year or 18,000 miles, whichever comes first. Problem must occur three or more times under warranty OR eight problems must occur OR in the shop 30 or more days in the first year. Motorcycles are covered under the OH Lemon Law.</p>
<p><a title="Connecticut Lemon Law" href="http://www.lemonlaw.com/connecticut-lemon-law.html"  target="_blank">Connecticut Lemon Law </a>: First problem must occur within the first 24 months or 18,000 miles, whichever comes first, and can continue 4x throughout the original and/or extended manufacturers warranty period. Connecticut&#8217;s Lemon Law also applies to vehicles that are in the shop for repair thirty (30) or more calendar days during the first 18,000 miles or 24 months (whichever comes first) and these days do not have to be consecutive. Motorcycles are covered.</p>
<p><a title="New York Lemon Law" href="http://www.lemonlaw.com/new-york-lemon-law.html"  target="_blank">New York Lemon Law </a>:  First problem must first occur within the first 24 months or 18,000 miles, whichever comes first and happen 4 times. The New York Lemon Law also applies to vehicles that are in the shop for repair thirty (30) or more calendar days during the first year. Motorcycles are covered.</p>
<p><a title="New Hampshire Lemon Law" href="http://www.lemonlaw.com/new-hampshire-lemon-law.html"  target="_blank">New Hampshire Lemon Law </a>: Vehicles purchased or leased  in NH with a gross weight of under 9000 pounds, that suffer a problem that cannot be repaired after three attempts by an authorized manufacturer&#8217;s dealership. This nonconformity must occur within the warranty period. The New Hampshire Lemon Law also applies to vehicles that are in the shop for repair thirty (30) or more business days during the express warranty period.  Motorcycles are covered.</p>
<p>Under <a title="state lemon laws" href="http://www.lemonlaw.com/automobile-lemon-law.html"  target="_blank">State Lemon Laws</a>, you could be entitled to one of the following three possible remedies:<br />
1. First  remedy can be a new vehicle – an MSRP TO MSRP swap.  MSRP stands for manufacturers suggested retail price. You will receive a credit for the MSRP/sticker price of your car which can be applied to the MSRP of any new car within the manufacturer.  Ideally, if you are interested in the same car, there should be little or no upgrade cost.   Essentially, this is a trade WITHOUT depreciation.  You will be put into a new vehicle with the same amount of equity as your old vehicle.</p>
<p>2. A full refund of your money, including finance charges, taxes, tags, down payment trade in value minus a small mileage offset (When it comes to offsets, each state is different. You give back the car, it is branded a lemon and you are done. )</p>
<p>3. The third possible remedy is monetary compensation to reflect the diminished value of the car.  Part of what you pay for when purchasing a car is a manufacturers warranty and that is to ensure that the problems you fix are fixed efficiently and effectively and if they are not after a certain number of times, your warranty has been breached.  If you receive compensation, you will get to keep the car, the car is NOT branded in any way, shape or form, your warranty remains completely in effect and you do not need to disclose that you received this money at time of trade or sale.  FURTHERMORE, EVEN IF YOUR CAR IS FIXED, YOU COULD STILL BE ENTITLED TO THIS MONEY.</p>
<p>If a person does not fall under the Lemon law, that does not mean we can’t help them.  As long as they have been in under manufacturers warranty three times for the same problem or four times for the same problem in Maryland, we can file a claim under the Magnuson Moss Warranty Act.  This applies to cars that were either purchased used or the first problem fell outside the parameters of the State Lemon Law.</p>

The phones at <a title="pa lemon law nj lemon law" href="http://www.lemonlaw.com/" >1-800 LEMON LAW</a> are ringing with many distressed drivers who are dealing with <a title="lemon law water leak entries" href="http://www.lemonlaw.com/wordpress/category/water-leak/" >water leaks</a>. On this blog, we have discussed why it is so important to continue to bring these leaks to your service manager&#8217;s attention, especially since leaks can lead to mold and mildew.</p>
<p>Many vehicles are suffering with clogged sunroof drains and other component failures which are causing water to leak onto drivers side and passenger side floors, and in some cases, even contaminate electrical components.  We are also seeing a great deal of water leaks in trunks and spare wheel wells.</p>
<p>If you have a GMC Acadia, Saturn Outlook, Jeep Commander and Jeep Grand Cherokee, please be advised we are currently handing/have handled hundreds of water leak claims involving these types of vehicles.But, you are not alone.  This past month alone, we have opened water leaks claims against six other manufacturers as well. A leak can occur in any vehicle. Remember that in this tough economy, we are continuously seeing manufacturers cutting warranty repair costs.  Be as specific as possible with regard to when you noticed the leak and what areas of your vehicle appear to be affected.  Furthermore, it is essential that if you smell or see <a title="water leaks equal mold and mildew" href="http://www.lemonlaw.com/breakmold.html" >mold or mildew</a>, you immediately bring it to you dealer&#8217;s attention and if necessary, you request that carpeting and seats be replaced. Your family&#8217;s health and the value of your vehicle both could be at risk.</p>

<p>For the life of us, we cannot understand why consumers still insist on trying to do this by themselves, when you can have access to an experienced attorney who has worked on thousands of lemon law and breach of warranty claims (not only that, but we have three ASE-certified mechanics on staff to inspect our clients&#8217; vehicles and research their issues.)  The other day, a gentleman called with a real problem&#8211;he was two years into a four-year lease and he was experiencing many problems with his power-train.  Being that he thought he had a &#8220;slam dunk&#8221; case, he decided to represent himself through the NJ Lemon Law unit.  He couldn&#8217;t get a mechanic to testify on his behalf. The manufacturer hired attorneys to oppose his claim.  He ended being offered a very minimal settlement which only covered a few lease payments.  He now has decided to buy himself out of his lease, which means he is going to take a huge financial hit.  This is all because he thought he could handle this on his own.  We have seen many other claims where the consumer was promised a new car, only it turned out to be a trade and the consumer found themselves stuck in a terrible situation.  If you are not a doctor, can you diagnose someone with a chest pain? If you are not a contractor, can you build a house and ensure it&#8217;s going to last the test of time?  The legal help is free, the participation is minimal.  You can keep driving your car throughout the entire process&#8230;.if you don&#8217;t take advantage of what the Law provides, then you are partly to blame for whatever happens.</p>
<p>We know that It sounds too good to be true, but we can assure you it is for real. <p>Now, remember this is a legal process, so we can&#8217;t guarantee that you will receive a repurchase if you open a claim with us, but it could be possible.</p>
<p>Under the Laws we work with, a repurchase is the maximum remedy a consumer can receive.  Repurchases are reserved where the consumer has suffered a significant non-conformity which has affected the use, value and safety of the vehicle, and the problem has reoccurred repeatedly.  Another possible remedy under the <a title="lemon law information" href="http://www.lemonlaw.com/auto-lemon-law.html"  target="_blank">Lemon Law </a>is a new car. This known as an MSRP to MSRP swap, which is essentially a trade without the depreciation you would normally suffer.  As you know, the minute you drive a car off the lot, the value of the car depreciates significantly.  If you receive a swap, we take the MSRP from the sticker price of your car and apply it to the MSRP of a brand new car.  So, essentially you are getting a brand new car with the same features, and you have the same amount of equity in the new car as you did in the old car. The depreciation you would normally deal with does not apply.</p>
<p>There is also a third remedy under the <a title="state lemon law" href="http://www.lemonlaw.com/automobile-lemon-law.html"  target="_blank">State Lemon Laws </a>and most commonly under the <a title="magnuson moss warranty act lemon law blog entries" href="http://www.lemonlaw.com/wordpress/category/magnuson-moss/"  target="_blank">Federal Magnuson Moss Warranty Act</a>&#8211;significant monetary compensation to reflect the diminished value of the vehicle for the problems you have incurred. This could apply if it is fixed after three repairs; if the problem is not threatening the overall use, value, or safety f the vehicle (i.e. radio);  it falls outside the lemon law mileage provisions; or if you purchased the car used but it still has a manufacturers warranty.  If you receive money, it is non-taxable and YOU GET TO KEEP YOUR CAR and your car is not branded in any way, shape or form.  Plus, <span style="text-decoration: underline;">your warranty remains completely in effect, so the manufacturer  is  still obligated to fix the car if problems persist,</span> and you do not need to disclose that you received this money at time of trade or sale.  You may do whatever you want with the money.  You may have previously read in our blog about the Volvo SUV owner who received $7,000 after he heard Communications Director Michael Sacks on the radio. Here are some other folks who received monetary awards <span style="text-decoration: underline;">in the last four months</span>(All of these folks kept their vehicles and had their attorney fees paid sepearately by the manufacturer):</p>

<li>2008 Volvo C70 &#8212; problems with convertible top, fixed after 4th attempt. Client received $10,000.</li>
<li>2008 Ford Ranger &#8212; client received $5,000.</li>
<li>2007 Ford Expedition &#8212; client received $6,000.</li>
<li>2005 Ford F350 &#8212; client received $7,000.</li>
<li>2007 Ford Expedition &#8211; client received $4,000.</li>
<li>2008 Toyota Rav 4 &#8212; client received $5,500.</li>
<li>2009 Dodge Journey purchased in another state but registered in PA &#8212; client received $6,750.</li>
<li>2006 Dodge Caravan &#8211;client received $5,250.</li>
<li>2007 Jeep Liberty &#8212; client received $5,000.</li>
<li>2006 Chrysler Town &amp; Country with 32,000 miles &#8212; client received $3,250.</li>
<li>2006 Subaru Forrester with 61,000 miles &#8212; client received $4,000 (settled in 60 days).</li>
<li>2008 Land Rover LR 3 with 25,000 miles &#8212; client received $4,250.</li>
<li>2008 Saab 9-7 with 37,000 miles &#8212; client received $5,500.</li>
<li>2005 Saab 9-3 with 40,000 miles and the lease almost completed &#8212; client received $3,000.</li>
<li>2005 Mazda 3 with 50,536 miles &#8212; client received $4,000.</li>
<li>2006 Mazda 6 purchased used &#8212; client received $4,000.</li>
<li>2006 Mazda MPV &#8212; client received $4,500 (settled in 30 days).</li>
<li>2007 Mazda CX9 &#8211;client received $5,000 (settled in 45 days).</li>
<li>2006 Honda Civic with 32,700 miles, problems fell outside of lemon law &#8212; client received $3,500.</li>
<li>2005 Chevrolet Tahoe with problem starting at 29,000 miles and lease up &#8211; client received $4,000.</li>
<li>2005 Chevrolet Impala with problem starting at 25,000 miles &#8212; client received $3,000.</li>
<li>2004 BMW 7-series certified pre-owned with 56,600 miles &#8212; client received $2,500.</li>
<li>2004 BMW 5-series with problem starting at 52,000 miles &amp; extended wty &#8211; client received $3,000.</li>
</ul>

			<content:encoded><![CDATA[<p>As the rain has been pouring down this past week, the calls have been pouring into <a title="lemon law pennsylvania new jersey massachusetts ohio delaware" href="http://www.lemonlaw.com/" >1-800 LEMON LAW</a> . We have been successfully resolving a large number of water leak claims recently, especially in General Motors SUVs.  But, GM drivers are not alone; I just took a call from a gentleman who has been in 7 times for a water leak in his trunk&#8230;and he drives a 2007 Honda Accord! There is no doubt that as the weather continues to get wetter, many distressed drivers will locate a leak. So what do you do if you find a drip?</p>
<p>We have repeatedly provided tips on what to do <a title="water leak lemon law" href="http://www.lemonlaw.com/wordpress/summer-showers-bring-more-than-flowers/" >if your car leaves you all wet</a>. Provided you are under manufacturers warranty, make sure you take your car to an authorized manufacturers dealer as promptly as possible. And, when you pick up the car, make sure you also pick up a repair invoice that outlines the problem and what they have done to resolve it.  Keep these invoices in a safe place. If you are facing this problem repeatedly, and the service manager is leaving you out to dry, <a title="get rid of your lemon" href="http://www.lemonlaw.com/rid.html" >you need to take action</a>.  If you are in the shop three times under warranty for a leak, you have the right to file a lemon law or breach of warranty claim EVEN IF THEY EVENTUALLY FIX THE PROBLEM.  Why?  Because your vehicle has suffered a non-conformity which significantly affected its use, value and safety.  A decent claim could result in significant monetary compensation&#8230;we are talking a partial or full refund&#8230;possibly even a new car. And as you know, under your lemon laws and federal laws we work with, <a title="lemon law help is free" href="http://www.lemonlaw.com/auto-lemon-law.html" >the legal help is completely FREE</a>.</p>
<p>And let&#8217;s say they fix the leak?  How sure are you that the leak will not return? Or worse yet, you may discover <a title="mold and mildew water leaks in cars" href="http://www.lemonlaw.com/breakmold.html" >mold and/or mildew</a>. Unfortunately, one thing we see time and time again are folks who do not open a claim because their problem is fixed&#8230;and then it pops up again 15,000 or 20,000 miles &#8220;down the road.&#8221;  The case is weaker. The remedy is usually weaker.</p>

			<content:encoded><![CDATA[<p>We frequently mention our TV and radio appearances on the blog, with the hope that consumers will tune in and learn.  Automotive Consumer Advocate Michael Sacks, <a title="lemon law " href="http://www.lemonlaw.com"  target="_blank">1-800 LEMON LAW </a>Director of Communications, recently joined Spencer Graves on WDEL&#8217;s Consumer Hotline, when a call came in from a distressed driver with a Volvo XC90.  He had close to 50,000 miles on his vehicle and he was constantly complaining about a transmission problem.  The dealer was being as helpful as possible; they replaced several components but after a while, they told him it was &#8220;a normal characteristic of the vehicle.&#8221;  The listener did not know what to do; he loves his vehicle but he thought he was entitled to something for his problem. Michael asked the listener to forward his repair invoices to him Monday morning.</p>
<p>Michael reviewed the invoices with the 1-800-LEMON LAW legal team and it turned out the listener had a strong claim under the <a title="Magnuson Moss Warranty Act" href="http://www.lemonlaw.com/wordpress/category/magnuson-moss/"  target="_blank">Magnuson Moss Warranty Act</a>.  Three weeks later, he settled his claim for $7,000, plus he gets to keep his vehicle, the extended warranty is in full effect (so if there is a transmission problem, Volvo is obligated to fix it), and the car is not branded in any way, shape or form.  Needless to say, our client was very happy.</p>
<p>This comes on the heels of Ernie from Wilkes Barre, PA who called when he heard Michael on WILK News Radio. He had already gotten rid of his Land Rover after he suffered numerous problems and he wanted to know if we could do anything.  He sent in his paperwork and <a title="lemon law" href="http://www.lemonlaw.com/auto-lemon-law.html"  target="_blank">Lemon Law </a>Attorney <a title="lemon law lawyer jacqueline herritt" href="http://www.lemonlaw.com/lemon-law-attorney.html#jacquelineherritt"  target="_blank">Jacqueline Herritt </a>succeeded in getting him $5,000. Ernie received $5,000 just for listening, and faxing in a few papers!  And, of course, neither consumer paid a dime for our legal help.</p>

<p>The most common question we receive at <a title="800 lemon law" href="http://www.lemonlaw.com"  target="_blank">1-800 LEMON LAW </a>is &#8220;How do I know my car is a lemon?&#8221; So, today on the lemon law blog, we thought we would provide a rundown of the lemon laws in each of the States we work in&#8230;.But first, answers to five of the most frequently asked questions:</p>
<p>First, YOU CAN NOT RETURN A CAR IN THE FIRST 72 HOURS. This is a common misconception from the days of door-to-door sales, when folks would ring your doorbell and sell you a vacuum or a set of encyclopedias. Once you sign on the dotted line, the car is yours.  Period. Make sure that the right price is listed on the contract, make sure you can afford the car, make sure it&#8217;s the finance rate you agreed to and for goodness sake, NEVER EVER EVER sign a blank contract!</p>
<p>Second, THE DEFENDANT IS NOT THE DEALER.  Yes, we know the dealer is lovely and we know you don&#8217;t want to get them in any trouble.  But, they don&#8217;t make the car.  They are the middle man and they have nothing to do with filing a lemon law claim. In fact, when filing a claim, we ask clients not to discuss the case with the service manager or threaten the dealer that you are going to file a suit.  We do not want you to create a hostile relationship between you and the dealer.  Also, we are NOT a fan of last chance letters. So, you give the dealer a last chance to fix it&#8230;and they don&#8217;t.  Then what?  If you don&#8217;t have a lawyer to enforce the letter, you are stuck in a catch-22.  Again, the law offers <a title="free lemon law help" href="http://www.lemonlaw.com/rights.html#lawyer"  target="_blank">FREE help</a>&#8211;Take advantage of it!</p>
<p>Third, EVEN IF YOU FALL OUTSIDE OF THE LEMON LAW, WE STILL MAY BE ABLE TO HELP YOU. Do not be discouraged if you have a used car or a motorcycle or ATV in a state that does not cover them. If your problems are covered under an original or extended manufacturers warranty, you could be entitled to MONETARY COMPENSATION, plus you get to keep your vehicle, your warranty remains in full effect, and the vehicle is NOT branded in any way.</p>
<p>Fourth, EVEN IF YOUR CAR IS FIXED AFTER THE THIRD, FOURTH, OR FIFTH REPAIR, you could still be entitled to compensation.  The fact is that every car comes with a manufacturers warranty and that is to ensure that problems are fixed efficiently and effectively and they have not been.  So, we feel you are entitled to money back, significant money, to reflect the diminished value of the car as a result of your problems. Again, if you receive money, the car is NOT branded and the warranty is fully in effect. Plus, the money is non-taxable.</p>
<p>Fifth, THERE ARE THREE POSSIBLE REMEDIES UNDER THE LAWS WE WORK WITH.  Keep in mind this is a legal process, so there are no guarantees, but here is what we are looking at.  Maximum remedy is a full buyback, including taxes, tags, finance charges, etc minus a small mileage offset as prescribed your state.  You return your car to the dealer and it is branded a lemon.  Second, an MSRP to MSRP swap&#8211;MSRP stands for manufacturers suggested retail price&#8211;basically, you are getting behind the wheel of a brand new car, with same amount of equity as your old car.  It&#8217;s trade without depreciation.  Third, if we can&#8217;t get a buyback or a swap, we aim to get you as much money as possible in compensation to reflect the diminished value as a result of the problem incurred. Plus, as mentioned before, you get to keep the car.</p>

<p><a title="pennsylvania lemon law" href="http://www.lemonlaw.com/pa-lemon-law.html"  target="_blank">Pennsylvania Lemon Law</a> :  First problem must occur in first 12 months or 12,000 miles whichever comes first.  Problem must occur three or more times under warranty OR the car is in the shop 30 or more days within the first year, and those days do not have to be consecutive. Car must be purchased (or leased) and registered in PA.  Motorcycles are not covered under <a title="pa lemon law" href="http://www.lemonlaw.com/pennsylvania_lemon_law.html"  target="_blank">PA Lemon Law  </a>(but they are covered under the Federal Magnuson Moss Warranty Act so we can still help!)&#8211;Kimmel &amp; Silverman was directly responsible for getting leased cars included under the PA Lemon Law.</p>
<p><a title="new jersey lemon law" href="http://www.lemonlaw.com/nj-lemon-law.html"  target="_blank">New Jersey Lemon Law </a>:  <a title="nj lemon law ranking" href="http://www.lemonlaw.com/nj-lemon-law-ranking.html"  target="_blank">Second most effective Lemon Law in the Nation</a>! First problem must occur in first 24 months or 18,000 miles which ever comes first. Problem must occur three or more times under warranty OR the car is in the shop for 20 days in the first 24 months and they do not have to be consecutive. Motorcycles are covered under <a title="nj lemon law" href="http://www.lemonlaw.com/new_jersey_lemon_law.html"  target="_blank">NJ Lemon Law</a>. Vehicle can be purchased, leased or registered in New Jersey.</p>
<p><a title="delaware lemon law" href="http://www.lemonlaw.com/delaware-lemon-law.html"  target="_blank">Delaware Lemon Law </a>: First problem must occur in the first year of ownership.  Problem must occur four or more times under warranty OR the car is in the shop 30 or more BUSINESS days in the first year. Vehicle can be purchased, leased or registered in Delaware. Motorcycles are not covered under <a title="de lemon law" href="http://www.lemonlaw.com/delaware_lemon_law.html"  target="_blank">DE Lemon Law  </a>(but they are covered under the Federal Magnuson Moss Warranty Act so we can still help!)</p>
<p><a title="massachusetts lemon law" href="http://www.lemonlaw.com/massachusetts-lemon-law.htm"  target="_blank">Massachusetts Lemon Law</a>: First problem must occur in the first year or 15,000 miles whichever comes first. Problem must occur three or more times under warranty OR the car is in the shop 15 BUSINESS days in the first year. 			<content:encoded><![CDATA[<p>As the comments continue to pour in regarding our entry on <a title="ford paint problems lemon law blog entry" href="http://www.lemonlaw.com/wordpress/more-problems-for-ford-paint-defects-in-2000-2005-models/"  target="_blank">paint defects with 2000-2005 Ford vehicles</a> (54 so far, but who&#8217;s counting?), we thought now would be a good time to discuss when a paint problem can turn into a <a title="lemon law rights" href="http://www.lemonlaw.com/rights.html"  target="_blank">lemon law </a>or <a title="mag moss warranty law" href="http://www.lemonlaw.com/wordpress/get-cash-plus-keep-your-car/"  target="_blank">breach of warranty </a>claim. </p>
<p><a title="lemon law pa nj oh de ma md" href="http://www.lemonlaw.com"  target="_blank">We</a> frequently receive calls from distressed drivers who are quite peeved over their paint.  If the dealer is making any effort to fix the problem, either by buffing, or compounding, or painting certain components, you may have grounds to file a claim. Make sure that you ask for a repair invoice after each visit.  These invoices should outline your complaint and what was done to fix the vehicle.  Depending on the invoices, we may be able to argue that the paint problem has diminished the value of the vehicle and therefore, the consumer is entitled to remedy under <a title="state lemon law summaries" href="http://www.lemonlaw.com/automobile-lemon-law.html"  target="_blank">State Lemon Law </a>or <a title="cbs 3 story on warranty law" href="http://cbs3.com/consumer/lemon.law.car.2.728576.html" onclick="javascript:pageTracker._trackPageview('/outbound/article/cbs3.com');" target="_blank">Federal Warranty Law</a>.</p>
<p>Unfortunately, many folks call to complain of paint chips on their hood.  These chips are often caused by road debris and while it&#8217;s extremely frustrating, these repairs are not covered under warranty. However, repairs that may be covered include paint peeling, rust, and blotches or scratches in the finish.</p>
<p>It&#8217;s important to ask questions.  If you feel that your paint defect may be affecting the value of the vehicle (and you are still covered under a manufacturers warranty), bring the issue to your service manager. <p>GREENSBURG (KDKA, 7/11/08) ― With gas prices up, motorcycle sales are rising too. Some motorcycles can get fifty, even sixty miles per gallon, but what if you run into trouble? If your motorcycle turns out to be a lemon, the <a title="pennsylvania lemon law" href="http://www.lemonlaw.com/pa-lemon-law.html"  target="_blank">Pennsylvania Lemon Law </a>doesn&#8217;t cover <a title="pa motorcycle lemon law rights" href="http://www.lemonlaw.com/motorcycle-rv-lemon-law.htm"  target="_blank">motorcycles</a>, so what can you do? Here&#8217;s how one Greensburg rider fought back and won.</p>
<p>Brian Markiewicz of Norvelt spent close to $15,000 two years ago for his motorcycle, a brand new Yamaha Roadster, but his problems began the day he bought it.</p>
<p>&#8220;On the way home, it would pop back through the carburetor, hesitate and stall,&#8221; explained Markiewicz.</p>
<p>Markiewicz says it&#8217;s a problem that&#8217;s caused him more than a few close calls, but even though he took his bike back to the dealer for repairs at least seven times, nothing was done that fixed the problem with his bike.</p>
<p>Brian Markiewicz found help through Pennsylvania <a title="lemon law firm" href="http://www.lemonlaw.com/about.html"  target="_blank">lemon law attorneys</a>, <a title="lemon law" href="www.lemonlaw.com" target="_blank">Kimmel and Silverman</a>. Brian learned that even though the state lemon law doesn&#8217;t cover motorcycles, there is a federal law that does.</p>
<p>&#8220;There is still recourse if you have a motorcycle that&#8217;s not working the way it should and it hasn&#8217;t been repaired by the manufacturer,&#8221; explained Brian&#8217;s attorney, Kimmel &amp; Silverman Pittsburgh Managing Attorney <a title="pittsburgh lemon law attorney Christina Gill Roseman" href="http://www.lemonlaw.com/lemon-law-attorney.html#christinaroseman"  target="_blank">Christina Gill Roseman</a>.</p>
<p>It&#8217;s the Magnuson Moss Warranty Act, a law that covers not only motorcycles but computers, ATVs, any product that is under warranty, has problems and those problems aren&#8217;t fixed in a reasonable period of time. Usually three or more attempts to fix the problem is considered reasonable.</p>
<p>Attorney Christina Gill Roseman took Brian&#8217;s case to court. Arbitrators awarded Brian a settlement of $3,644 for diminished value of his motorcycle due to the unfixed problem.</p>
<p>&#8220;I keep the bike and I can have it repaired by anybody else or trade the bike or get rid of it or whatever I want to do with it, &#8221; said Markiewicz.</p>
<p>Not only did Brian win a money settlement, he was awarded attorney fees as well. That&#8217;s because under the <a title="magnuson moss warranty act" href="http://www.lemonlaw.com/wordpress/outside-lemon-law-try-the-mag-moss-act/" >Magnuson Moss Warranty Act</a>, consumers like Brian Markiewicz who fight back and win don&#8217;t pay.</p>
<p>&#8220;These are fee shifting statutes, &#8220;explained Gill Roseman. &#8220;That means if the plaintiff is successful, the manufacturer pays the fees and costs associated with their case.&#8221;</p>
<p>&#8220;So far, &#8221; said Markiewicz, &#8220;it hasn&#8217;t cost me a penny. I am amazed.&#8221;</p>
<p>The moral of this story for consumers is if you have a product under warranty and can&#8217;t get satisfaction with repairs, you can take the company to court at a price you can afford. Nothing!</p>

			<content:encoded><![CDATA[<p>Strapped for cash?  Who isn&#8217;t?  Unemployment is up. News reports continue to flood in about how poor the economy is. As gas prices soar higher, the money in our wallets seems to dwindle. Our homes are not worth what they were and neither are our stock portfolios. So, how would $2,000, $3,000 or even $5000 sound?  In a non-taxable check, and you don&#8217;t have to do much to get it.  You may be entitled to a large sum of money and the answer may be right in front of your nose&#8230;in your driveway to be exact (and no, we are not talking about selling your car). If you have read it before on the blog, it bears repeating, because consumers who call into the <a title="800 lemon law" href="http://www.lemonlaw.com" >1 800 LEMON LAW </a>hotline can&#8217;t beleive it.  This is a Federal law which applies to every state we work in:  <a title="Pennsylvania Lemon Law" href="http://www.lemonlaw.com/pa-lemon-law.html" >Pennsylvania</a>, <a title="new jersey lemon law" href="http://www.lemonlaw.com/nj-lemon-law.html" >New Jersey</a>, <a title="Delaware Lemon Law" href="http://www.lemonlaw.com/delaware-lemon-law.html" >Delaware</a>, <a title="Maryland Lemon Law" href="http://www.lemonlaw.com/maryland-lemon-law.html" >Maryland</a>, <a title="Massachusetts Lemon Law" href="http://www.lemonlaw.com/massachusetts-lemon-law.htm" >Massachusetts</a>, <a title="Ohio Lemon Law" href="http://www.lemonlaw.com/ohio-lemon-law.html" >Ohio</a>, <a title="Washington DC Lemon Law" href="http://www.lemonlaw.com/dc-lemon-law.html"  target="_blank">Washington DC</a>, <a title="Vermont Lemon Law" href="http://www.lemonlaw.com/vt-lemon-law.html"  target="_blank">Vermont</a>, <a title="Rhode Island Lemon Law" href="http://www.lemonlaw.com/ri-lemon-law.html"  target="_blank">Rhode Island </a>and <a title="New Hampshire Lemon Law" href="http://www.lemonlaw.com/new-hampshire-lemon-law.html"  target="_blank">New Hampshire</a>.</p>
<p>It&#8217;s a little known Federal law called the <a title="Magnsuon Moss articles" href="http://www.lemonlaw.com/wordpress/?s=Magnuson+Moss+Warranty+Act" >Magnuson Moss Warranty Act</a>, that&#8217;s not discussed by car dealerships when you purchase your car.  It&#8217;s a statute that is not heavily promoted or publicized but it applies to cars, or any products that cost over $25 and are covered by a manufacturers warranty.  What is says is that if you find that you have to get your car repaired three or more times for the same thing, it means that the warranty has not proven to efficient or very effective.  And for that reason, you could be entitled to monies that reflect the diminished value of the car as a result of the problem. So, that darn window motor that&#8217;s been replaced, the air conditioner that hasn&#8217;t been blowing cool air,  the water leak in the trunk that was finally fixed after four tries, or that nav system that&#8217;s gone through quite a few upgrades could mean thousands in your pocket PLUS<br />
**You get to keep your car<br />
**Your warranty remains completely in effect and they still have to fix your car.<br />
**Your car is NOT branded in any way (like the lemon law), so know one can look up a carfax report and determine that you received this money.<br />
**You do NOT need to  disclose that you received this money when selling or trading your car. <br />
**Like the Lemon Law, the Magnuson Moss provides a provision which entitles consumers to completely <strong><a href="http://www.lemonlaw.com/rights.html"  target="_blank">FREE LEGAL HELP</a></strong>, so they are on equal footing with the manufacturers.<br />

And unlike the lemon law, this law can also apply to used cars, <a title="motorcycle lemon law" href="http://www.lemonlaw.com/wordpress/yamaha-problems-dont-stall-take-action/" >motorcycles</a>(when state laws do not apply), and some seacraft too (like jet skis and sea doos). You read this right&#8211;This is free money and it applies to any car or truck which has repeated problems under an original or extended manufacturers warranty (normally three times in for the same problem) .</p>

<p>PHILADELPHIA (CBS 3) ― Are you having mechanical problems with your car? While state lemon laws can help, some Federal laws are designed to protect you too. In fact the Magnuson-Moss Act may be your best bet.</p>
<p>Jan Jeffries bought a certified pre-owned Jaguar about a year ago. Almost immediately he had problems. The anti-lock brakes were malfunctioning and needed repeated repairs. While Jan&#8217;s mechanical problems weren&#8217;t covered by state lemon law, he was entitled to compensation under the Federal Magnuson-Moss act.</p>
<p>&#8220;If the vehicle is under warranty and you&#8217;ve had problems with it, subject to repair, and it has not been resolved, you have federal, Manguson-Moss warranty rights.&#8221; says attorney Craig Kimmel. The Magnuson-Moss Act applies to vehicles under their original or extended manufacturers warranty, and the car must be in the shop for 3 or more times for the same problem. Kimmel says, &#8220;We&#8217;re talking brakes, transmission, suspension, head lights, water leak, paint defect, any of these problems and more, those issues the consumer should step up and force the manufacturer to comply with the warranty and if they can&#8217;t, call a lawyer.&#8221;</p>
<p>That&#8217;s what Jan Jeffries did. He says, &#8220;I got $6,000 from Jaguar as compensation for what would ultimately be reduced value of the vehicle.&#8221;</p>
<p><strong>The Magnuson-Moss Warranty Act</strong></p>
<p>The Magnuson-Moss Warranty Act is a Federal Law that protects the buyer of any product which costs more than $25 and comes with an express written warranty. This law applies to any product that you buy that does not perform as it should.</p>
<p>Your car is a major investment, rationalized by the peace of mind that flows from its expected dependability and safety. Accordingly, you are entitled to expect an automobile properly constructed and regulated to provide reasonably safe, trouble-free, and dependable transportation &#8211; regardless of the exact make and model you bought. Unfortunately, sometimes these principles do not hold true and defects arise in automobiles. Although one defect is not actionable, repeated defects are as there exists a generally accepted rule that unsuccessful repair efforts render the warrantor liable. Simply put, there comes a time when &#8220;enough is enough&#8221; &#8211; when after having to take your car into the shop for repairs an inordinate number of times and experiencing all of the attendant inconvenience, you are entitled to say, &#8216;That&#8217;s all,&#8217; and revoke, notwithstanding the seller&#8217;s repeated good faith efforts to fix the car. The rationale behind these basic principles is clear: once your faith in the vehicle is shaken, the vehicle loses its real value to you and becomes an instrument whose integrity is impaired and whose operation is fraught with apprehension. The question thus becomes when is &#8220;enough&#8221;?</p>
<p>As you know, enough is never enough from your warrantor&#8217;s point of view and you should simply continue to have your defective vehicle repaired &#8211; time and time again. However, you are not required to allow a warrantor to tinker with your vehicle indefinitely in the hope that it may eventually be fixed. Rather, you are entitled to expect your vehicle to be repaired within a reasonable opportunity. To this end, both the federal Moss Warranty Act, and the various state &#8220;lemon laws,&#8221; require repairs to your vehicle be performed within a reasonable opportunity.</p>
<p>Under the Magnuson-Moss Warranty Act, a warrantor should perform adequate repairs in at least two, and possibly three, attempts to correct a particular defect. Further, the Magnuson-Moss Warranty Act&#8217;s reasonableness requirement applies to your vehicle as a whole rather than to each individual defect that arises. Although most of the Lemon Laws vary from state to state, each individual law usually require a warrantor to cure a specific defect within four to five attempts or the automobile as a whole within thirty days. If the warrantor fails to meet this obligation, most of the lemon laws provide for a full refund or new replacement vehicle. Further, this reasonable number of attempts/reasonable opportunity standard, whether it be that of the Magnuson-Moss Warranty Act or that of the Lemon Laws, is akin to strict liability &#8211; once this threshold has been met, the continued existence of a defect is irrelevant and you are still entitled to relief.</p>
<p>One of the most important parts of the Magnuson-Moss Warranty Act is its fee shifting provision. This provision provides that you may recover the attorney fees incurred in the prosecution of your case if you are successful &#8211; independent of how much you actually win. That rational behind this fee shifting provision is to twofold: (1) to ensure you will be able to vindicate your rights without having to expend large sums on attorney&#8217;s fees and (2) because automobile manufacturers are able to write off all expenses of defense as a legitimate business expense, whereas you, the average consumer, obviously does not have that kind of economic staying power. Most of the Lemon Laws contain similar fee shifting provisions.</p>
<p>You may also derive additional warranty rights from the Uniform Commercial Code; however, the Code does not allow you in most states to recover your attorney fees and is also not as consumer friendly as the Magnuson-Moss Warranty Act or the various state lemon laws.</p>

			<content:encoded><![CDATA[<p>At <a title="lemon law " href="http://www.lemonlaw.com" >1-800-LEMON LAW</a>, we receive countless calls from folks who purchased a used car and ended up being taken for a ride.  Sometimes the car has a salvage title, or it will not pass inspection, or it just falls apart.  Many times, these distressed drivers have little or no protection under the State and Federal Laws we work with. Now, Mayor Nutter&#8217;s consumer advocate Lance Haver is working hard to change that in Philadelphia.</p>
<p>This past Monday, The Philadelphia City Council has approved a lemon law bill for used cars, and if that bill becomes law, drivers will have 72 hours to get their car checked out by a mechanic following the purchase.  If the car is not drivable, the dealer will either have to fix the problem or allow the consumer to return the car for a full refund.</p>
<p>This is a bill whose time has come, according to <a title="lemon law firm" href="http://www.lemonlaw.com/about.html" >Kimmel &amp; Silverman </a>Founding Attorney <a title="lemon law lawyer craig kimmel" href="http://www.lemonlaw.com/lemon-law-attorney.html#craigthorkimmel" >Craig Thor Kimmel</a>. &#8220;In Philadelphia, used car sales occur with greater frequency than in less populated areas for the simple fact that insurance on a used car in the city is cheaper than insurance on a new car.  Often people who buy used must rely entirely on what they are told from their salesperson, as there is little or no warranty remaining. In the case of new cars, repairs are covered under warranty for free but sadly, that is not often the case for used cars. Avoiding an unreliable car and its high repair bills is critical.  This type of consumer protection would certainly be welcomed.&#8221;</p>
<p>As you know, the <a title="pennsylvania lemon law" href="http://www.lemonlaw.com/pa-lemon-law.html" >Pennsylvania Lemon Law</a> currently does not apply to used cars.  However, if you are under a manufacturer&#8217;s warranty and you have been back three or more times, you could be entitled to monetary damages under a Federal law known as the Magnuson Moss Warranty Act. 			<content:encoded><![CDATA[<p><span style="font-family: Times New Roman;"><span style="font-size: 14pt">Certainly, we have all heard of the <a href="http://www.lemonlaw.com" ><span style="color: #800080;">lemon law </span></a>at one time or another.  Every State has one and they are designed to protect car owners when their ride turns sour.  But, what if you fall outside the lemon law provisions?  Perhaps, you live in Pennsylvania, and your problem occurred at 13,000 miles, rather than 12,000? Or you have a used car with a manufacturers warranty and the check engine light just will not go off?  Is the manufacturer off the hook?  Is the consumer out of luck?  The answer is no.</span></span></p>
<p><span style="font-family: Times New Roman;"><span style="font-size: 14pt">There&#8217;s a little known Federal law called the Magnuson Moss Warranty Act, that&#8217;s not discussed by car dealerships when you purchase your car.  It&#8217;s a statute that is not heavily promoted or publicized but it applies to cars, or any products that cost over $25 and are covered by a manufacturers warranty.  What is says is that if you find that you have to get your car repaired three or more times for the same thing, it means that the warranty has not proven to efficient or very effective.  </span></span></p>
<p><span style="font-family: Times New Roman;"><span style="font-size: 14pt">And for that reason, you could be entitled to monies that reflect the diminished value of the car as a result of the problem. So, that darn window motor that&#8217;s been replaced, the air conditioner that hasn&#8217;t been blowing cool air,  the water leak in the trunk that was finally fixed after four tries, or that nav system that&#8217;s gone through quite a few upgrades could mean thousands in your pocket PLUS</span><strong><span style="font-size: 14pt">**You get to keep your car</span></strong><span style="font-size: 14pt">**Your warranty remains completely in effect and they still have to fix your car. </span><span style="font-size: 14pt">**Your car is not branded in any way (like the lemon law)</span><span style="font-size: 14pt">**You do not disclose that you received this money when selling or trading your car.  </span><span style="font-size: 14pt">**Like the Lemon Law, the Magnuson Moss provides a provision which entitles consumers to completely free legal help, so they are on equal footing with the manufacturers. </span><span style="font-size: 14pt">And unlike the lemon law, this law can apply to used cars. </span></span></p>

<p>2008 will soon be upon us and as folks reneter reality after their holiday break, their cars will no doubt provide a source of anger and frustration.  <strong>Do you know that if the same problem occurs three or more times under manufacturers warranty,  you could be at least be entitled to monetary damages and possibly a complete refund or buyback?  </strong>(In some states, such as Maryland and Delaware, you will need four occurrences.) </p>
<p>The fact of the matter is that many distressed drivers are letting thousands of dollars slip between their fingers because they are not properly informed.  While folks are familiar with the &#8220;Lemon Law&#8221; per se, there are other laws out there as well, including the Federal Magnuson Moss Warranty Act.  In addition, many times consumers turn to the dealership for information on their consumer rights.  That&#8217;s kind of like asking the man who sold you the chainsaw what to do after you accidentally cut your thumb.  They are not attorneys and have no real clue about your rights.  If you are lucky, they will refer you to our Lemon Law Firm such as ours.  If not, they could see dollar signs and persuade you to trade your lemon in for a new car, increasing their profit margin and your negative equity.  Remember, the only person interested in helping you is YOU!  You need to be informed about your rights.</p>

<li><strong>Here are some questions you need to ask a lemon law firm:</strong>

<li>How long has the lawyer been practicing law?</li>
<li>How long has the lawyer practiced Lemon Law?</li>
<li>Does the lawyer have a license to practice in the client&#8217;s state? (Very important)</li>
<li>Has the lawyer received any recognition, honors or awards for work performed in the client&#8217;s state?</li>
<li>Has a successful verdict the lawyer tried ever been reported in a legal case reporter? If so, identify the case.</li>
<li>When was the last time the lawyer received a successful verdict in a Lemon Law case?</li>
<li>Can the lawyer provide any references of other clients, attorneys, or judges in the client&#8217;s state?</li>
<li>If my case cannot be resolved right away, and a lawsuit is necessary, where would it be filed and why?</li>
<li>How is the lawyer compensated?</li>
<li>Is the client advised in writing at the start of the case what their rights and responsibilities are?</li>
<li>Is a mechanical expert utilized by the law firm to help prove the case, and if so, is his/her involvement free to the client? (We have four ASE-certified experts on staff)</li>
<li>What does the client need to do to assist the lawyer in a case?</li>
<li>Does the lawyer have a physical office within the client&#8217;s state?</li>
<li>Is a lawyer and/or their staff available to speak with clients on a daily basis?</li>

<li><strong>Locations</strong> &#8211; Beware of the fake office!<strong>Our lawyers work in each state we practice, and each of our six offices is fully-staffed.</strong> Each office is managed by an experienced Lemon Law attorney and has a staff of knowledgeable litigation support personnel. Very few other Lemon Law firms have physical offices in other states, but many of them say they do. Try calling the local phone number or stopping by sometime though, and there is no office and no live body.
<p>Unfortunately, firms sometimes buy &#8220;addresses&#8221; to look more established and gain new business. We know of one firm that has no offices in many of the states they claim to practice in. If you see a little asterisk explaining that these are &#8220;of counsel&#8221; locations, it means they are not directly owned or operated by the law firm. Be as wary of the &#8220;of counsel&#8221; lawyer as you would be of the &#8220;of counsel&#8221; surgeon. Limited knowledge and lack of experience is often the hallmark of such arrangements and that could detrimentally affect your case.</p>

Craig Kimmel co-wrote the Nation&#8217;s first-ever Computer Lemon Law Bill way back in 1999, and persists in working towards its passage in Pennsylvania and other states.</p>
<p>Our class-action claims have been used to effect substantial changes in production cars suffering from brake, engine and other concerns.</p>
<p>New Jersey Judges recently invited Founding Partner Robert Silverman and several K&amp;S attorneys to train mediators and arbitrators on how to hear Lemon Law cases.</p>
