Proposed Consumer Electronics Lemon Law in NJ

Legislators in New Jersey have proposed a measure that would extend traditional “lemon law” protections to customers purchasing consumer electronics. A-3978, also known as the Consumer Electronics Warranty Lemon Law, unanimously passed an Assembly committee last week. The idea behind the legislation, its sponsors said in a statement to PoliticsNJ.com, is that because some consumers spend thousands of dollars per year on electronics, they deserve the same sort of protections that car owners do.

To avoid prosecution under the proposed law, sellers would have to meet several criteria: Replace items that could not be repaired after three attempts; refund defective items; provide at-home service, if promised, within 72 hours, and comply with several other provisions. Failure to comply would result in a $10,000 fine for first offenders, under the state’s Consumer Fraud Act. If passed, New Jersey’s bill would be the first law of its kind in the nation, although going after electronics salespeople for Lemon Law violations is not entirely unheard of; Kimmel & Silverman, one of the East Coast’s top Lemon Law firms, lists electronics along with cars, trucks, motor homes and boats as “lemon” items for which it goes after fraudulent sellers. Traditionally, such claims have been brought under the Magnuson-Moss Warranty Act, a federal law passed in 1975 that governs all consumer warrantees.

The proposed New Jersey law “would narrow and articulate what specific rights are, so [consumers] don’t have to see a lawyer and look it up,” said Craig Kimmel, co-founder and managing partner of Kimmel & Silverman. Kimmel said the proposed law would “give teeth” to existing legislation, but said it is too early in the process to tell how much effect the law would have.“I don’t know if it would need changes to make it practical, and palatable for everyone involved,” Kimmel said. The New Jersey bill passed the state’s Assembly Consumer Affairs Committee on May 10 and is now on the desk of Assembly Speaker Joseph J. Roberts, who will decide whether to bring it for a full assembly vote. If the measure passes both the assembly and state senate, it will reach the desk of Gov. Jon Corzine.

DaimlerChrysler AG announced early this morning that it has sold 80.1-percent of the Chrysler – Dodge – Jeep trio to Cerberus Capital Management, a New York equity firm that specializes in turning around troubled companies. Cerberus reportedly paid $7.4 billion to obtain majority ownership, with Daimler AG retaining a 19.9-percent share. The new Cerberus unit will be called Chrysler Holding LLC. Daimler’s partial interest will allow the two entities to work together on products that already share technology.

Cerberus owns a variety of high profile companies, some within the auto industry, including National and Alamo Car Rentals, and a controlling share of GMAC financial services. Since it’s a private firm, Cerberus won’t have to answer to shareholders, something that analysts feel will give the new LLC more freedom to achieve its long-term goals, rather than churning out the short-term boosts that keep shareholders happy.

A quote from Cerberus Capital Management Chairman John Snow: “Cerberus believes in the inherent strength of U.S. manufacturing and of the U.S. auto industry. Most importantly, we believe in Chrysler.” You might recognize Mr. Snow from a previous job — Secretary of the Treasury under President George W. Bush.

Daimler’s getting about one-fifth of the amount it paid for Chrysler back in 1998. Did Cerberus get a buy, or will the group have a difficult time bringing the brand back to the position it was in after Lee Iacocca revived it in the 1980’s? Daimler’s no doubt hoping its minority interest will pay off down the road.

VW Jetta–A Best Bet & On The Car Complaint Index–How Can This Be?

Eagle eyed blog readers may notice that one vehicle, the Volkswagen Jetta, is mentioned both on the 2007 Car Complaint Index (in the number 3 position) and among the compact cars in this year’s Best Bets. How can that be?

“Best Bets” are based on expected performance in ten categories (crash tests, safety features, fuel economy, rollover, overall, maintenance and repair costs, warranties, insurance costs, and complaints), with the greatest emphasis placed on crash test performance and complaints.

The Car Complaint Index compares the number of complaints submitted to the National Traffic Safety Administration to the number of sales. The Jetta has been one of VW’s top selling cars for many years, and with higher sales sometimes comes a higher number of complaints from drivers. As we discussed in a previous blog entry, these comments can be subjective. However, it is important to note that we saw consumers complaining about the same components, namely electrical, so we feel their observations may carry some merit and perhaps this is an issue the manufacturer may want to look into.

On the other side of the coin, the CCI does not take any of the other factors into consideration, most notably VW’s 4 year/50,000 mile warranty, safety features, and fuel economy, all of which are ideal for a consumer looking for a compact vehicle.
